Consular Processing

There are more than one way to apply for lawful permanent resident status after your immigrant petition has been approved and you have been given a visa number right away (aka Green Card). 

You can apply for an immigrant visa at a U.S. Department of State consulate overseas if you’re outside of the country to enter and become a permanent resident. Consular processing is the name given to this Process.

We determine your eligibility for a green card or lawful permanent residence as the initial step of Consular processing.

Most immigrants qualify when a family member or employer files a petition on their behalf. Others acquire the status of a refugee or an asylum seeker first, or they do so by several other unique conditions.

You often need someone else to submit an immigrant petition on your behalf once you’ve determined which category, in your opinion, best matches your circumstance.

Broadly, there are the following categories:

  • Family-based petition
  • Employment-based petition
  • Humanitarian based petition

A U.S. citizen or lawful permanent resident relative is required if you wish to apply for a Green Card based on your family relationship locally.

Although you often submit immigrant petitions to USCIS domestically, you occasionally have the option to submit one for a close relative (the spouse, child, or parent of a U.S. citizen) at a USCIS field office, U.S. embassy, or consulate abroad. 

Your U.S. citizenship and the presence of an international USCIS field office are mandatory for the initiation of this step. Other supportive factors may also play a role.
